Code of Ethics and Conduct
The County of Delta, Colorado, hereby adopts a Code of Ethics and Conduct for members of appointed boards, commissions, and committees (local public bodies) to promote public confidence in the integrity of local government.
Preamble
The following Code of Ethics and Conduct is adopted by the Board of Delta County Commissioners to promote public confidence in those appointed to serve on behalf of Delta County. A member of a local public body appointed by the Board of County Commissioners holds a position of public trust, created by the confidence that the Board, as elected representatives of the citizens and electorate of Delta County, places in the integrity of the boards, commissions, and committees serving the public interest. An appointed member shall perform their duties for the benefit of the people of Delta County, adhering to the highest ethical standards. Violations of this Code may result in removal from their positions.
This Code of Ethics and Conduct provides guidance in performing responsibilities as representatives of Delta County in accordance with applicable portions of Article 18, Title 24, Parts 1 and 2, "Standards of Conduct," of the Colorado Revised Statutes. These provisions apply exclusively to members of Delta County local public bodies appointed by the Board, including any ad hoc committees acting in official capacities.
Core Values
Attitudes, words, and actions should demonstrate, support, and reflect the following core values for the community's well-being:
- Integrity/Honesty
Be honest with fellow board members, County government staff, officials, the public, and others.
Communicate frankly and realistically.
Make unpopular decisions if required by the County's best interests.
Acknowledge others' contributions.
Avoid knowingly using false or inaccurate information.
Safeguard objectivity, fairness, and impartiality by avoiding relationships or transactions that might compromise integrity. - Responsibility/Protecting the County's Interests
Comply with ethical standards, restrictions, and prohibitions outlined in Article 18, Title 24 of the Colorado Revised Statutes, and Article XXIX, Section 3 of the Colorado Constitution.
Recuse oneself from decisions when personal or family financial interests may be affected.
Avoid giving special treatment to individuals or groups.
Maintain confidentiality concerning litigation, personnel, property, or other County affairs without proper authority, and do not use this information for personal gain.
Serve Delta County’s interests above personal or private interests. - Fairness/Accountability
Promote meaningful public involvement in decision-making.
Treat all persons, claims, and transactions fairly and equitably.
Base decisions on issue merits.
Follow protocols when receiving substantive information from outside sources.
Contribute to transparency and open communication. - Respect for Fellow Appointed Officials, Staff, and the Public
Voluntarily remove oneself from discussions or voting when there is a conflict of interest.
Disclose uncertainties to permit objective decisions on potential conflicts.
Treat fellow members, County staff, and the public with professional courtesy and respect.
Encourage consensus-building and value diverse opinions.
Respect distinctions between roles of appointed members and County staff.
Attend meetings prepared to participate actively. - Proper and Efficient Use of Public Resources
Avoid using public resources for private gain.
Make decisions in compliance with legal and regulatory requirements.
Demonstrate prudent stewardship of County assets.
Consider impacts of decisions on the County and its residents. - Conflicts of Interest and Undue Influence
Disclose known or potential conflicts of interest or attempts at undue influence.
Recognize that conflicts of interest and undue influence may impair impartiality and unbiased decision-making.
Avoid personal or familial involvement that could present conflicts.
Implementations and Enforcement
Members of local public bodies appointed by Delta County are primarily responsible for practicing and promoting ethical standards to enhance public confidence in government integrity.
All current and new appointees shall affirm in writing receipt and understanding of this Code, agreeing to adhere to its provisions. Assistance in understanding and applying the Code will be provided by County administration and legal staff. The County Attorney or their designee shall serve as a resource for guidance on appropriate actions consistent with this Code.
Breach of the Code of Ethics and Conduct
Members appointed to local public bodies must meet the qualifications and standards set forth in this Code at the time of appointment. Appointees may be removed for breaches in accordance with County policies, local governing document requirements, and statutory requirements.
A periodic review of this Code will ensure its effectiveness and relevance. Amendments or repeals of this Code may occur only through formal action by the Board of County Commissioners.
